Terms of Service

By accessing or using the KiwiStays website (kiwistays.com) or making a booking through our platform, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

These terms apply to all visitors and users of KiwiStays. If you do not agree to these terms, please do not use our website or services. KiwiStays reserves the right to update these terms at any time with 30 days' notice via the website.

2. Booking & Payment

  • A booking is confirmed only after successful payment of the 50% deposit and receipt of a confirmation message from KiwiStays.
  • The remaining 50% balance is due 3 days before your check-in date. A payment link will be sent to your registered email/phone.
  • Failure to pay the balance on time may result in cancellation of the booking without refund of the deposit.
  • All prices are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise.
  • Payments are processed by Razorpay and subject to their payment terms.

3. Cancellation Policy

Cancellations are handled according to our standard cancellation policy. Refund amounts depend on how far in advance you cancel before your check-in date.

To request a cancellation, contact us at bookings@kiwistays.in or via WhatsApp. Cancellations are not effective until confirmed in writing by KiwiStays.

4. Guest Responsibilities

As a guest, you agree to:

  • Not exceed the maximum occupancy specified for the property.
  • Follow the house rules provided by the host before check-in.
  • Not use the property for illegal activities, commercial events, or large parties without prior written approval.
  • Treat the property and its contents with care. You are liable for any damage beyond normal wear and tear.
  • Check out by the stated check-out time. Late check-outs may incur additional charges.
  • Provide accurate information (name, guest count, contact details) when booking.

5. Damage Policy

  • Minor damage under ₹2,000 is absorbed by KiwiStays — no charge to you.
  • Significant damage will be documented with photos and an estimate shared with you. Costs will be deducted from the security deposit or charged separately.
  • Security deposits (where applicable) are refunded within 3 business days of checkout, provided no damage is found.

6. Limitation of Liability

KiwiStays acts as a platform connecting guests with property hosts. While we vet all properties and maintain quality standards, we are not the property owner and cannot guarantee every aspect of your stay.

KiwiStays is not liable for personal injury, loss of property, or other damages arising from your stay beyond what is covered by our damage and service guarantee policies. Our maximum liability is limited to the amount paid for your booking.

Our 10-Minute Service Guarantee applies to issues reported at check-in. If we fail to respond within 10 minutes, your first night is free.

7. Intellectual Property

All content on this website — including text, images, logos, and design — is the property of KiwiStays or its licensors. You may not reproduce, distribute, or use any content without prior written permission.

8. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these terms or your use of KiwiStays shall be subject to the exclusive jurisdiction of the courts of Goa, India.
